GOPA BOXING CLUB WAIVER & RELEASE OF LIABILITY

1. Assumption of Risk & Release of Liability

In consideration of my use of the exercise equipment and facilities provided by Gopa Boxing Club, I, on behalf of myself, my heirs, executors, administrators, successors, and assigns, hereby waive, release, and discharge Gopa Boxing Club, its owners, employees, trainers, officers, directors, affiliates, and insurers from any and all liability for personal injuries (including death) or damages arising out of my participation, whether caused by ordinary negligence or otherwise, except for gross negligence, reckless conduct, or willful misconduct .

I acknowledge and understand that:

• Boxing and martial arts training involve significant risks, including but not limited to physical contact, punches, strikes, sparring, falls, concussions, broken bones, muscle strains, and other injuries.

• The risk of injury cannot be entirely eliminated, even with proper training and supervision.

• I voluntarily assume all risks associated with my participation and agree not to hold Gopa Boxing Club liable for any injuries, damages, or claims resulting from my participation, including ordinary negligence by the gym, its staff, or trainers.

2. Indemnification Clause

I agree to indemnify, defend, and hold harmless Gopa Boxing Club, its owners, employees, trainers, officers, directors, affiliates, and insurers from any and all claims, demands, damages, lawsuits, liabilities, costs, or expenses (including legal fees, court costs, and settlements) arising from injuries or damages sustained by me or any third party related to my participation.

I understand that this indemnification obligation includes covering all legal expenses incurred by Gopa Boxing Club due to claims resulting from my actions, regardless of whether I believe I was at fault.

3. Acknowledgment of Personal Responsibility

• I am solely responsible for my own safety and well-being while using the facilities, equipment, or participating in any activities at Gopa Boxing Club.

• I certify that I am in good health and have no medical conditions that would prevent my safe participation. I understand that it is my responsibility to consult a physician before engaging in any training.

• I understand that Gopa Boxing Club provides supervision and instruction only during scheduled training sessions and is not responsible for my actions outside of those sessions.

• I agree to follow all gym rules and regulations, which are posted in the facility and available upon request.

• I acknowledge that I have read and understood the gym’s rules and agree to abide by them at all times.

• I understand and agree that Gopa Boxing Club is not responsible for lost, stolen, or damaged property.

4. Medical Treatment Authorization 

I authorize Gopa Boxing Club staff to obtain emergency medical care for me (or my minor child, if applicable) if necessary. I understand that I am financially responsible for any medical treatment incurred as a result of participation.

I confirm that I have adequate health or accident insurance to cover any medical expenses related to my participation.

5. Photo & Video Release

I grant Gopa Boxing Club irrevocable, royalty-free permission to use my likeness in photographs, videos, or other digital media for promotional purposes, including but not limited to:

• Social media, websites, marketing materials, and advertisements.

• Print materials, brochures, and any other promotional content.

I understand that I will not receive compensation for the use of these images or recordings, and Gopa Boxing Club retains full rights to modify, publish, and distribute them as needed.

6. Parental Consent 

If the participant is under 18, a parent or legal guardian must sign below:

I, (Parent/Guardian Name) , as the parent/legal guardian of (Minor’s Name) , understand and acknowledge the risks of boxing and martial arts training. I voluntarily assume all risks on behalf of my minor child and agree to all terms stated in this waiver.

I further waive, release, and discharge Gopa Boxing Club from any liability for injuries or damages sustained by my child, except in cases of gross negligence, reckless conduct, or willful misconduct .

7. Severability Clause

If any provision of this waiver is found to be invalid or unenforceable , the remaining provisions shall continue in full force and effect .

8. Duration of Waiver

This waiver shall remain in effect indefinitely , unless revoked in writing by the participant or parent/guardian.

9. Arbitration Clause 

I agree that any dispute, controversy, or claim arising out of or related to this waiver, my participation, or any activities at Gopa Boxing Club shall be resolved exclusively through binding arbitration in Oakland, California.

I waive my right to file a lawsuit in a court of law and understand that arbitration is a private dispute resolution process that is binding and enforceable under state and federal law.
